      Matthew J. Simone is a partner at the law firm of Gerstenzang, Sills, Cohn & Gerstenzang. He received his Bachelor’s Degree from Binghamton University in 2010 and graduated from Albany Law School in 2013.

      During Matthew’s tenure at Binghamton University, he majored in financial management, was a Division 1 Scholarship Athlete and captain of the baseball team in his senior year. In law school, Matthew interned at the Schenectady County Public Defender’s Office and the Albany County District Attorney’s Office.

      Prior to joining the firm, Matthew was an associate attorney at a local firm where he practiced in the areas of DWI defense, criminal and civil litigation, personal injury and vehicle & traffic matters. He was admitted to practice law in New York in January of 2014, and was admitted to practice in U.S. District Court for the Northern District of New York in June of 2015.

      To Blow or Not to Blow, That Is The Question, DWI On Trial: The Big Apple XXII, Albany, New York, December 9, 2022, New York State Bar Association, This lecture is designed to help lawyers systematically handle the late night phone call from an individual under arrest for DWI. The lecture will not only cover how to answer the question, but to do it in a way that does not incriminate the individual making the call. In addition, the program will cover representing an individual accused of refusing to submit to a chemical test during the virtual DMV hearing, and refusal consequences.

        I reside in another state and was arrested on a warrant (felony) in my home and incarcerated to await extradition to NY. Not knowing any attorneys in NY my spouse contacted Mr Simone and he immediately began nonstop efforts to get me released so I can appear on my own in court. The jail personnel stated they have never had anyone receive as many calls from their attorney as I had in my 30 hour stay. Constant communication from Mr. Simone continued (even nights and weekends) until my legal issue’s conclusion. My family and I never felt we were battling our legal issues alone. We also appreciated his patience and understanding throughout all our emotions. I have PTSD and a service dog and my thoughts can run wild at times. We also appreciated his professionalism; keeping my dignity intact during this challenging time. He accepted me for who I was without hesitation and judgement. Mr. Simone is extremely knowledgeable in the Practice of Law. He was tireless in his efforts and strategized with me instead of leaving us in the dark. He is a good listener and was honest, whether it was what we wanted to hear or not because his main focus was to do what was in our best interest for the best possible outcome. We discovered several police procedure issues, discrepancies and missing critical information.         Prior to hiring Matt, I had never been in any trouble with the law. I had no criminal record and never came close to committing any crimes in my life. I unfortunately found myself in a terrible criminal situation in late August and after being arraigned in court, we hired Matt Simone as my lawyer. After looking at my case and evidence of mental health struggles, he immediately went to work establishing a rapport with my psychologist. Although the early stages of the case were as bad as they could be, Matt never panicked and took everything in stride. Matt took a look at the human side of my offences and clearly knew that I was struggling with some mental health, of course I also took accountability for this and really put in the work with multiple mental health specialists. After a couple letters to the prosecutor, the charges I was facing were considerably lowered to a point where I didn’t need to worry. While it’s true many things went in my favour, Matt Simone is the engine who kept chugging and continued to fight for the most favourable outcome. As my case has concluded now and I can put this ordeal behind me, I can gladly say that Matt’s persistence and willingness to fight for my life was put on display and I would SINCERELY recommend him as your attorney should you get into any trouble. It’s goes a long way towards having as good a lawyer as Matt and not just in the legal sense, but in the human sense as well, he cared deeply about how my mental health treatment is and was going, and his efforts gave me the best outcome.         Attorney Matthew Simone was excellent to work with during my court proceedings. He possessed every aspect, in my opinion, a great attorney should have. He was professional, knowledgeable, personable, and most importantly caring. Every step of my case I felt Matt was doing everything in my best interest. He was very passionate about getting the best possible outcome. Matt also was able to provide hope that this wasn’t the end of the world. It’s a long process and he creates a well thought out game plan in order to help you with the situation that you are in. Originally I was arrested for aggravated dui, common law dui, and a traffic violation. Our goal was to have no criminal offenses and we accomplished just that. Throughout my case attorney Matt Simone found multiple issues with the police proceedings and was able to get my chemical test suppressed at trial. Multiple times the DA threatened to take plea deals off the table. However, attorney Matt Simone advised me not to panic and to trust him in reaching our goals. Because of this, I was only offered better plea deals each time we met in the court room. The out come of my case was getting all arrest records sealed and destroyed while pleading guilty to a DWAI which is only a traffic violation. With the help of attorney Matt Simone I was able to get back on my feet and put this incident behind me. If Matt had not worked on my case so diligently I could of been facing much harsher sentencing. I would recommend Matt to anyone in need of legal counsel. He is truly the best out there.
