      Biography

      Jordan Merson is a partner who heads the firm's office in New York City. Widely regarded as one of the city's top medical malpractice, personal injury and sexual assault lawyers, Merson primarily handles cases that have resulted in recoveries of $1 million or more and has routinely litigated those that have produced verdicts and settlements greater than $10 million. Many of his cases have gained local and national media attention and he has been quoted often in newspapers and on television.

      In his most recent major victory, Merson in late 2018 won a $28 million jury verdict against a Westchester County school district for inadequate supervision after a special education student was raped after being led off the school campus. The verdict was believed to be the largest in a case involving physical and sexual assault in New York State history. (See news story)

      For at least five years before that, Merson held the largest single plaintiff jury verdict in Westchester County — $11.3 million for a six-year-old girl who suffered brain damage because doctors failed to recognize her congenital heart condition. That verdict earned Merson a spot in New York State's first-ever attorney “Hall of Fame” for medical malpractice verdicts and settlements.

      Merson has taken a leadership role for victims of sexual assault in New York and Pennsylvania and has recovered millions of dollars -- more than $10 million in the last year alone -- for individuals of all ages who have been sexually abused or assaulted. He has been actively involved in representing child sex abuse survivors in the Independent Reconciliation Compensation Program (IRCP) administered by the Roman Catholic Archdiocese of New York. The archdiocese has borrowed $100 million to cover all claims. Merson is likewise involved in the Brooklyn diocese's IRCP. Merson has used some of the proceeds from his cases to help those in need. In 2018, for instance, he made the largest single donation to the Survivors Network Against Priest Abuse (SNAP) at the organization's annual convention.

      In Pennsylvania, he recently spearheaded legal action against the Solebury School in Bucks County on behalf of a 29-year-old former student who claimed she was sexually abused by her gym teacher. The lawsuit followed a grand jury report detailing instances of sexual abuse at the school over a 50-year period. (Read article)

      In a highly publicized case, Merson filed suit on behalf of a mother who broke her neck while protecting her children from a falling tree in Central Park in New York City. Merson told the New York Post: "We have concerns that she may never walk the same again or walk at all again."

      Other notable cases Merson litigated include the $265 million Amtrak 188 derailment case and a large nationwide product liability arbitration that resulted in settlements totaling in the hundreds of millions of dollars.

      Merson has worked on numerous birth injury cases. He obtained settlements of $17 million and $14.8 million for children who were permanently injured due to delayed C-sections. Other birth injury cases resulted in recoveries of $14.4 million, $11.3 million and $5.5 million.

      Among Merson’s other legal victories:

      $21 million settlement in a product liability case involving a defective product that caused catastrophic burn injuries.

      $11 million settlement for a woman who was rendered a quadriplegic as the result of untreated post-delivery bleeding.

      $12 million recovery for a burn victim in an assault case.

      $9.5 million settlement in a medical malpractice case for a patient rendered a paraplegic due to failure to timely perform spine surgery.

      $8 million settlement in a race discrimination and sexual harassment case that involved workers receiving less pay and being threatened and groped.

      $5.8 million recovery for a woman who suffered quadriplegia due to botched heart valve repair.

      $5 million for a victim of sexual harassment in which a worker was not included in certain money-making transactions due to his refusal to participate in discriminating conduct.

      $4.5 million settlement for a lawyer who died because doctors failed to diagnose and treat meningitis.

      As a result of his passionate advocacy on behalf of seriously injured people, Merson has been nationally recognized and received the following awards over the past few years: 2016 and 2017 Top 10 Personal Injury Lawyer awarded by the National Association of Personal Injury Attorneys; Top 100 Trial Lawyer by the National Trial Lawyers Association; 2016 Lawyer of the Year for Who's Who; Best Lawyers of America, Tier One; and Super Lawyers, annual inclusion as a “Rising Star.”

      Merson attended Fordham University School of Law, where he was co-captain of the basketball team, which won the law school league championship played at Madison Square Garden. He earned his bachelor’s degree at Boston University, graduating magna cum laude.
