Richard B. Tucker, III is a shareholder in the firm and concentrates his practice in the field of litigation, particularly appellate litigation. He has argued cases in the United States Supreme Court, Third Circuit Court of Appeals, and the Pennsylvania Supreme, Superior and Commonwealth Courts. He has handled a variety of civil cases involving general commercial transaction claims, trusts and estates, letters of credit, insurance coverage, workers' compensation, ERISA benefits, and employment issues.
One of Dick's most significant cases was Ferens v. John Deere Co. which he successfully argued before the U.S. Supreme Court. The Court agreed with Dick's position that a federal district court must apply the state law of the state where the lawsuit was filed even after the lawsuit has been transferred to a federal court in another state at the plaintiff's request. As a result, an injured farmer was granted recourse using the longer statute of limitations of the state in which the lawsuit was filed and in which the defendant company did business. The statute of limitations in the farmer's home state had expired.
Dick graduated from the University of Virginia in 1965 and from the Columbia University Law School in 1968. He is a member of the Allegheny and Pennsylvania Bar Associations and serves on its Appellate Advocacy Committee. He is also an elected member of the American Law Institute. He is also a member of the Allegheny County Bar Association where he serves on its Appellate Practice Committee and was previously the Chairman. Dick has an AV rating in the Martindale-Hubbell Law Directory, which is the highest rating for legal ability and ethical standards awarded by this national directory of lawyers.
Dick has also been selected for inclusion in The Best Lawyers in America, appellate law category, since 2007. He has also been named as a Pennsylvania Super Lawyer in the appellate law category since 2006.
In May of 2007, Dick was featured in the article: "The Supreme Thrill. Meet Seven Lawyers Who Have Appeared in the Super Bowl of Law," which was published in Super Lawyers Magazine.
