In the fall of 2013, Mr. Dostart co-tried the case of Hackett v. Silva Trucking, et al. wherein the jury returned a verdict of $34,921,215.33 (an additional $4,664,330.48 in pre-judgment interest and expert costs were subsequently added to the verdict). This was the largest personal injury verdict in the State of California in 2013 and remains the largest personal injury verdict in Sacramento County.
Mr. Dostart's trial victories also include a $2.9 million verdict on behalf of a young woman rear ended by a commercial vehicle. The case went to trial after the last offer from the defense of $350,000 was rejected. The jury awarded the plaintiff more than $1 million for past and future medical care and an additional $1.9 million for past and future pain and suffering.
Mr. Dostart prosecuted a case with Mr. Buccola and Florida co-counsel involving the tragic death of a 21-year-old woman who fell during a parasailing incident while honeymooning with her husband. After multiple years of litigation across several states, the matter resolved just short of trial with a major hotel chain and multiple parasailing parts manufacturers contributing to a confidential settlement.
In another case involving a crane collapse and near-amputation arm injury, Mr. Dostart took over 30 depositions while co-prosecuting the case with Mr. Buccola and Mr. Greenblatt. After never receiving a single offer from the crane company, the case resolved on the first day of trial with the defendant crane company paying $3.4 million.
Outside of the typical personal injury case, Mr. Dostart recently tried a civil battery case involving an elderly man who was attacked in a Peet's Coffee shop after a previous road-rage incident between the plaintiff and the assailant's wife. Despite minimal medical treatment and only $18,000 in medical expenses, the jury sent a loud message to the bully defendants by awarding plaintiff $268,407 in damages.
In 2018, Mr. Dostart represented a Wisconsin family in a wrongful death claim that arose out of a rear-end collision involving a commercial semi-truck. After months of litigation, the matter resolved short of trial for $5,750,000.
Mr. Dostart grew up in the Sierra Foothills. When not advocating for his clients, he can be found spending time with his wife, Raina (the two met and started dating as teenagers), and their two precocious daughters, Mia and Gabriella. Mr. Dostart also enjoys Brazilian Jiu Jitsu.
