Walter E. Moak

I am currently suing Mr. Moak for legal malpractice of handling of my chapter 7 case. I learned he does not carry any malpractice insurance.. He has chosen to represent himself. As a former client and I asked Mr. Moak if my home asset appreciation was at risk of claim by the trustee to force a sale in Jan of ‘21. He advised it was not according to bankruptcy law. Five months later, I get email from Mr. Moak that trustee was claiming my home asset appreciation. Bankruptcy case law cited by the trustee supports the trustee . In sheer coincidence, the trustee assigned to my case established asset appreciation case law 10 years ago where she claimed the asset appreciation of another debtor and prevailed in the court in (Gebhart v. Gaughan). I hired another attorney to take over my bankruptcy representation. It ended up costing me thousands of dollars to settle with the trustee and additional legal fees to avoid losing my home.
